PSBC e-CNY Quick Pay Service Agreement
Dear Sir/Madam,
To safeguard your rights and interests, you should carefully read the terms and conditions of the PSBC E-CNY Quick Pay Service Agreement (hereinafter referred to as “this Agreement”), especially those containing bold headings or texts, before you sign it. If you have any doubts or questions, please consult Postal Savings Bank of China (hereinafter referred to as “PSBC”, “the Bank”, or “we”) or your attorney and relevant professionals. If you wish to consult business or make a complaint, please contact PSBC via our customer service hotline by dialing 95580.
This Agreement is a valid contract entered into by and between PSBC and the e-CNY wallet user (hereinafter referred to as “you”) regarding the use of the e-CNY Quick Pay Service (hereinafter referred to as “the Service”). To protect your rights and interests, please read this Agreement in its entirety before agreeing to it. By entering your payment PIN on the Quick Pay Service enabling page, you mean that you have fully understood this Agreement and are willing to abide by it in its entirety. If you do not agree with any content in this Agreement, or if you do not accurately understand our interpretation of the terms and conditions contained herein, please do not proceed with subsequent operations.
I. Introduction to the Service
1.1 The PSBC E-CNY Quick Pay Service: You may first link your PSBC e-CNY wallet to your account on the third-party platform for PSBC E-CNY Quick Pay Service. When you need to make payment on the third-party platform, you authorize the third-party platform to send a deduction instruction within the prescribed limit to us, so that we can deduct and transfer the specific amount of funds from your PSBC e-CNY wallet according to the instruction sent by the aforesaid third-party platform directly without verifying your payment PIN, dynamic SMS verification code, or other information.
1.2 You understand and agree that we have the right to amend this Agreement according to the changed business needs and to release the latest version of this Agreement in advance on our official website in accordance with the pertinent laws/regulations and regulatory requirements. You should follow up on and get the latest version of this Agreement released by us. If you don’t agree to the amended Agreement, you have the right to stop using the Service through such channels as the e-CNY APP and the third-party platform.
2. Functions of the Service
2.1 Since the Service involves the third-party platform, if the third-party platform has its own payment rules such as payment limit and authentication requirements, you should comply with the payment rules of the platform, in addition to our payment limit and authentication requirements.
2.2 You can view, on the e-CNY Quick Pay management page, the information of the third-party platform that you have authorized to provide you with the Service. Meanwhile, you can also disable the Service through such channels as the e-CNY APP and the third-party platform. After the Service is disabled, you won’t be able to conduct e-CNY transactions through the Service.
2.3 The Service charges no fee for now. If there are subsequent charges, we will notify you in advance of the rates and the timeframe in the form of announcements on our official website as prescribed by the pertinent laws, regulations, and regulatory provisions.
3. Use of the Service
3.1 You hereby agree and confirm that your use of the Service reflects your true intent, that you assume responsibility for the authenticity and validity of the instructions you send in the course of using the Service, and that such instructions are deemed as expressions of your true intent and cannot be changed or revoked. You undertake that you will assume all the risks arising from the operations that we carry out following your instructions, except for the faults for which we are responsible in accordance with the law.
3.2 The provision of the Service requires linking your e-CNY wallet to your personal account number on the third-party platform. By accepting this Agreement, you are deemed to have agreed to and authorized the third-party platform (contact information can be found on our official website) to obtain the mobile number you have used to sign up for your e-CNY wallet, the last four digits of your wallet ID, and the level of your wallet from us for the purpose of the Service. We will require the third-party platform to use your authorized information in accordance with the law and keep your information confidential.
3.3 You pledge that you will not use the Service to engage in any act that is illegal, goes against the purpose of this Agreement, or infringes on the rights and interests of other third parties. Otherwise, we have the right to unilaterally terminate the provision of the Service without bearing any liability. For any losses incurred by us as a result of your breach of the Agreement, you shall compensate us in full in accordance with the pertinent legal provisions.
3.4 You authorize the third-party platform to send deduction instructions to us, and authorize us to deduct and transfer the specified amount of funds from your PSBC e-CNY wallet to the e-CNY wallet designated by the third-party platform according to the instructions of such platform.
3.5 You hereby agree and confirm that you shall be liable for all financial disputes or breaches of contract caused by the failure to deduct/transfer the aforesaid amount of funds due to your own fault such as the insufficient balance in your e-CNY wallet or your wallet being unlinked, frozen, or canceled. We are not responsible for any failure or delay in deducting/transferring the relevant amount due to any reasons not attributable to us. You hereby confirm that any financial loss suffered by you due to the third-party platform shall be dealt with by and between you and the platform through negotiation.
3.6 You hereby agree and confirm that the Service is a value-added service provided by us to you, that your use of the Service reflects your true intent, and that you assume responsibility for the authenticity and validity of the instructions you send in the course of using the Service, except for the losses and liabilities that shall be borne by us due to our fault according to the law. If you disagree with the specific business types and transaction amounts related to the use of the Service, or if you have any dispute with the third-party platform over the goods or services you purchase, please negotiate with the platform or resort to judicial proceedings on your own.
3.7 To fulfill your legal obligations, prevent risks, and safeguard your funds, you agree to authorize the third-party platform to obtain from us the IP address used when you sign up for your e-CNY wallet and the unique user identifier generated by the e-CNY APP for the purpose of risk identification. You understand and accept that we will limit the scenarios, funding channels, payment limits, etc. when you use the Service for payment, and the specific limitations will be further noticed in the form of on-screen prompts. We have the right to lower your transaction limits as required for risk control purposes such as anti-money laundering (AML) and anti-fraud, which you should understand and accept. However, we will not raise the transaction limits set by you without your consent.
3.8 Unless otherwise stipulated in this Agreement, we can unilaterally terminate the provision of the Service to you, upon prior notice to you or through public announcement on our official website, for which we are not liable for compensation, unless otherwise prescribed by the pertinent laws. If we find, after the termination of the Service, that we have suffered damages as a result of your former use of the Service in violation of law or the purpose of this Agreement, we can still hold you liable for these damages and reserve the right to resort to judicial proceedings.
3.9 You should keep your identity information, wallet information, passwords, and mobile number properly. If you leak your wallet information, payment PIN, or other personal identity information, your funds may be at risk. In this case, you may disable the Service through channels such as the e-CNY APP and the third-party platform.
3.10 You should take responsibility for the authenticity and validity of the information provided and the legality of the sources from which the information is obtained, and agree that we may use the said information and data for AML, anti-telecommunications/network fraud, and other risk management purposes. You must refrain from using the Service and related funds for illegal and criminal activities such as money laundering, terrorist financing, and telecommunications/network fraud. In the event of any risk factors as defined by regulatory authorities or as recognized by us during the term of the Service, we reserve the right to conduct due diligence and suspend or terminate this Agreement if necessary.
4. Privacy Protection
4.1 We attach importance to the protection of your privacy, and your personal information will be protected and regulated in accordance with the PSBC E-CNY Wallet Personal Information Protection Policy.
5. Entry into Force
5.1 This Agreement shall come into effect when you check the box “I have read and agree to this Agreement” and enter your payment PIN to successfully enable the Service. Meanwhile, all authorizations granted under this Agreement shall also come into effect. Your authorizations shall terminate upon our receipt of your application for termination of this Agreement submitted through such channels as the e-CNY APP and the third-party platform. Prior to the termination, you shall assume the risks arising from the operations conducted by us in accordance with your authorizations, except for the faults for which we are responsible in accordance with the law.
6. Miscellaneous
6.1 To further improve the user experience, we will continue to update our services to provide users with upgraded versions, features, rules, etc. In the process, this Agreement may be updated accordingly, and the updated content will become effective from the date of release. If you do not agree with any changes, amendments, or interpretations made by us to the above content, you should immediately stop using the Service as agreed herein. Once you continue to use the Service, you are deemed to understand and accept our changes, amendments, or interpretations of the above content. If the updated content involves your major rights or responsibilities, we will inform you by means of public announcement, notice, etc.
6.2 Any dispute arising between the Parties in the performance of this Agreement shall be solved through amicable negotiation. Where such negotiation fails, either party may file a lawsuit to the people’s court in our domicile.
6.3 Please note that the notices, letters, etc. involved in this Agreement and all kinds of documents involved in the mediation, litigation, or arbitration under this Agreement can be served electronically (such as SMS, e-mail, and WeChat) or offline, both of which have the same legal force. The address for service is that you have reserved in our system. In case of any change to the address, you should inform us of the new address in writing/via e-banking/ customer service hotline/etc. If you fail to notify us of the change of address in time, the original address will prevail. Where you change the address for service and keep us informed, the new address shall prevail. When relevant documents are not actually received by you because you provide the wrong address for service, you fail to inform us of the change of address for service, or you refuse to accept such documents, the date of delivery shall be determined in one of the following manners: 1) if the documents are served by a person directly, the person may take photographs or videos to record the process of service and leave the documents at the address for service, and the date on which the documents are left at the address shall be the date of service; 2) in the event of delivery by post, the date of return shall be regarded as the date of delivery; and 3) if the electronic delivery is adopted, the time point when the information enters the system designated to receive electronic information shall be regarded as the time of service. Where you enter into mediation, litigation, or arbitration procedures with us due to this Agreement, the court may hear the case by modern means such as electronic or Internet technologies, and serve your litigation documents, initiate payment orders, or file legal proceedings in the manner stipulated in this Agreement.
6.4 The establishment, effectiveness, performance, and interpretation of this Agreement shall be governed by the laws of the People’s Republic of China. As to the matters for which there is no express provision in the law, the business rules formulated by us and the generally accepted business practices shall prevail. Specifically, the matters not covered in this Agreement shall be handled in accordance with the PSBC E-CNY Wallet User Service Agreement, the PSBC E-CNY Wallet Personal Information Protection Policy, and their auxiliary rules. Where this Agreement conflicts with the PSBC E-CNY Wallet User Service Agreement and its auxiliary rules, this Agreement shall prevail.
I declare that PSBC has informed me of the terms and conditions in this Agreement (especially those containing bold headings or texts) in accordance with the law, and has explained the concepts, content, and legal forces of related terms and conditions at my request. I am aware of and understand the aforesaid terms and conditions.
